SB 427, as it passed the Senate, prohibited a nongrandfathered or grandfathered health care service plan contract or health insurance policy from imposing any cost-sharing or utilization review requirements for certain antiretroviral drugs, devices, or products for the prevention of HIV/AIDS, and required a grandfathered contract or policy to provide coverage for those drugs, devices, or products. SB 427, as it passed the Senate, authorized the Department of Managed Health Care and its director to implement and enforce these provisions and, if the department assessed a civil penalty, required a hearing requested by a plan to be conducted by the Office of Administrative Hearings.
The Assembly amendments exempt individual and small group contracts and policies from the above-described cost-sharing or utilization review prohibition until January 1, 2026, additionally require a nongrandfathered contract or policy to provide coverage for certain antiretroviral drugs, drug devices, or drug products for the prevention of HIV/AIDS, require a high deductible health plan to comply with the cost-sharing requirements, and delete the enforcement authorization and hearing requirements for the department. The Assembly amendments also apply the bill’s amendments to the law as amended on February 6, 2024, by Chapter 1 of the Statutes of 2024.

SB 586, as it passed the Senate, removed specified exceptions to the deadline to achieve an urban level of flood protection by 2025 for the Mossdale Tract and the City of West Sacramento, and instead provided that the deadline to achieve an urban level of protection, or to make adequate progress on the construction of a flood system providing an urban level of protection, does not apply to the Mossdale Tract and the City of West Sacramento so long as a flood management agency has an active federal study, a completed federal study, or an authorized federal project awaiting the receipt of federal appropriations to advance design, construction, or project closeout activities, as specified. SB 586, as it passed the Senate, revised the Department of Water Resources’ authority to require the San Joaquin Area Flood Control Agency to contribute its fair and reasonable share of property damage caused by a flood to the extent that the state’s exposure to liability for property damage has been increased by cities or counties that unreasonably approve any new development in the Mossdale Tract between January 1, 2025, and when the urban level of flood protection is achieved. SB 586, as it passed the Senate, contained language describing the constitutional requirement that the state reimburse local agencies and school districts for certain costs mandated by the state.
The Assembly amendments, instead, extend the exception to the deadline for the Mossdale Tract and the City of West Sacramento to achieve the urban level of flood protection to 2040. The Assembly amendments extend the Department of Water Resources’ authority to require the San Joaquin Area Flood Control Agency and the West Sacramento Area Flood Control Agency to contribute its fair and reasonable share of property damage caused by a flood to the extent that the state’s exposure to liability for property damage has been increased by cities or counties unreasonably approving any new development in the Mossdale Tract and the City of West Sacramento, respectively, to between the years 2025 and 2040. The Assembly amendments require that, on or before December 31, 2028, and every 5 years thereafter until December 31, 2038, the West Sacramento Area Flood Control Agency and the San Joaquin Area Flood Control Agency provide a report to specified committees and subcommittees describing plans and actions taken to improve flood protection in the preceding 5 years in the City of West Sacramento and the Mossdale Tract, as specified. The Assembly amendments repeal these reporting requirements on January 1, 2039. The Assembly amendments delete language describing the constitutional requirement that the state reimburse local agencies and school districts for certain costs mandated by the state. The Assembly amendments declare that the measure is to take effect immediately as an urgency statute.
