SB 427, as it passed the Senate, prohibited a nongrandfathered or grandfathered health care service plan contract or health insurance policy from imposing any cost-sharing or utilization review requirements for certain antiretroviral drugs, devices, or products for the prevention of HIV/AIDS, and required a grandfathered contract or policy to provide coverage for those drugs, devices, or products. SB 427, as it passed the Senate, authorized the Department of Managed Health Care and its director to implement and enforce these provisions and, if the department assessed a civil penalty, required a hearing requested by a plan to be conducted by the Office of Administrative Hearings.
The Assembly amendments exempt individual and small group contracts and policies from the above-described cost-sharing or utilization review prohibition until January 1, 2026, additionally require a nongrandfathered contract or policy to provide coverage for certain antiretroviral drugs, drug devices, or drug products for the prevention of HIV/AIDS, require a high deductible health plan to comply with the cost-sharing requirements, and delete the enforcement authorization and hearing requirements for the department. The Assembly amendments also apply the bill’s amendments to the law as amended on February 6, 2024, by Chapter 1 of the Statutes of 2024.
